Terms of Service

Welcome to Taste Quest. These Terms of Service (“Terms”) govern your use of the Taste Quest website at tastequest.app and any related apps or services we provide (collectively, the “Service”). The Service is operated by Christopher DeVito (“we,” “us,” or “Taste Quest”). By creating an account or otherwise using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. Who can use Taste Quest

You must be at least 13 years old to use Taste Quest. If you’re between 13 and the age of majority where you live, you may only use the Service with the consent of a parent or legal guardian who agrees to these Terms on your behalf. We don’t knowingly collect data from children under 13; if you believe a child has used the Service, contact us and we’ll delete the account.

2. What Taste Quest is

Taste Quest is a personal restaurant journal and decision aid. You can build location-based lists of nearby restaurants, mark visits, leave ratings and notes, and use a random picker to choose a place to eat. Restaurant data is sourced from OpenStreetMap and other third-party providers. The Service is currently free, with a premium tier planned for the future (Section 9).

The lists you create, the visits you mark, the ratings you leave, and the notes you write (collectively, “Your Content”) are yours. We don’t claim ownership. By using the Service, you grant us a limited, non-exclusive license to store and display Your Content to you, as needed to operate the Service.

You agree that Your Content won’t:

6. Restaurant data — accuracy and disclaimer

Taste Quest pulls restaurant information (names, addresses, locations, cuisine tags, phone numbers, hours, websites) from third-party sources including OpenStreetMap, Google Places, and others. We don’t verify or guarantee this information. Restaurants close, change hands, relocate, change menus, or correct mistakes in their listings — sometimes faster than the underlying data updates.

You’re responsible for confirming details before you rely on them. Call ahead, check the restaurant’s own website, or visit in person before making important decisions based on what you see inTaste Quest.

7. The random picker is a suggestion, not a recommendation

When the random picker selects a restaurant for you, that’s a random outcome — not an endorsement, a quality assessment, or a guarantee that the restaurant is open, safe, or suitable for you. You decide whether and where to eat. Taste Quest is not responsible for your experience at any restaurant you visit, including but not limited to food quality, service, allergens, illness, or other outcomes.

8. Third-party services

Taste Quest is built on services from third parties (Supabase, Vercel, Resend, OpenStreetMap, Photon by Komoot, Google Places, Google AdSense, Stripe). The Service may also include links to websites or resources we don’t control. We’re not responsible for the availability, accuracy, content, products, or services of those third parties, and your use of them is governed by their own terms.

We display ads on the free version of Taste Quest via Google AdSense to offset hosting costs. By using the Service you consent to ad delivery and to the cookie behavior described in our Privacy Policy. If you’re in the EEA, UK, or Switzerland we’ll surface a consent prompt before personalized ads load.

11. Intellectual property

Subject to your rights in Your Content, the Service — including the Taste Quest name, logo, design, code, copy, and any features we build — is owned by us and protected by copyright, trademark, and other intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. Nothing in these Terms transfers any ownership.

Restaurant data sourced from OpenStreetMap is © OpenStreetMap contributors and licensed under the Open Database License.

12. Service availability and changes

We do our best to keep Taste Quest running but don’t guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also change features, limits, or pricing as the product evolves — if a change materially affects features you’re paying for under a future premium plan, we’ll give you reasonable advance notice.

13. Termination

You can stop using Taste Quest and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or create legal or security risk for us or other users. On termination, sections of these Terms that by their nature should survive (intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, governing law) will survive.

14. Disclaimers (the “as-is” clause)

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DON’T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, COMPLETE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DON’T WARRANT THE ACCURACY, RELIABILITY, OR LEGALITY OF ANY THIRD-PARTY DATA SHOWN THROUGH THE SERVICE, INCLUDING RESTAURANT INFORMATION.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TASTEQUEST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY EXPERIENCE AT A RESTAURANT YOU VISITED AS A RESULT OF USING THE SERVICE.

Our aggregate liability for all claims arising out of or related to these Terms or the Service will not exceed the greater of (a) the total amount you have paid us in the twelve months immediately before the event giving rise to the liability, or (b) USD $50.

Some jurisdictions don’t allow the exclusion of certain warranties or limitation of certain damages. To the extent the disclaimers and limitations above are not enforceable in your jurisdiction, they will apply to the maximum extent permitted by applicable law.

16. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising from (a) Your Content, (b) your use of the Service in a way that violates these Terms or any law, or (c) your violation of any third-party right.

17. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Before filing any formal claim, you agree to first contact us at hello@tastequest.app and try to resolve the dispute informally. If we can’t resolve it within 60 days, any unresolved dispute will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to personal jurisdiction there. Each party waives any right to a jury trial. To the extent permitted by law, you and Taste Quest agree that any dispute will be brought in an individual capacity and not as part of a class action.

18. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we’ll update the “Last updated” date above and, where reasonable, give notice through the Service or by email. Your continued use of Taste Quest after changes take effect means you accept the revised Terms.

A note on these Terms. Taste Quest is a one-person operation. These Terms were drafted in good faith based on common practice for consumer apps; they aren’t a substitute for advice from a licensed attorney.
